No, because the issue was the woman had consented to penetration with a penis, not a dildo.
In the other case, some similarities in that the man there covered the eyes of his victims (as in other case), and they thought they were having sex with a woman. Although I think in the US also charges since videos were taken and posted without permission as well.
But, yeah, this is kind of the crux of it. If you consent to being blindfolded and having someone you think/claims to be female give you a blow job, and they turn out to be male...............Will the courts decide it depends whether or not you asked them what sex they were, and what if you asked instead -- 'ere, you're not a bloke are you? If you assumed something about them based on their appearance versus what is a legally 'true' answer to 'are you a real woman/are you female/ etc etc'
Will the law have to define what 'are you a woman' means?
