There are no gaps. Transadvocate lawyer at a recent govt attended forum highlighted three areas of improvement
1 maternity- style leave for transition
2 legal protection against discrimination for 'non binary' people
3 more discrimination questionnaires

There's no way to legally protect "non-binaries" unless we can define what that means, which nobody seems to be able to do (because it's nonsense).

Medical leave to recover from procedures I'd be fine with, why not? Not "well I want a few months off at full pay because being trans is hard" leave though.

You are purposefully missing my point (well, several of them).

I am not trans, I am female. What is the difference between me (if I cut my hair short, with my bound breasts from too small hair, masculine work environment and masculine roles at home) and a non-binary person?

The point is that the category non-binary could be used to exclude women who are not seen as feminine enough.

I am not talking about what trans people fear, I am talking about what I fear.

I want to know how and why I can still call myself a woman when this non-binary category exists that others might think suits me better because I am not feminine enough.

To have your sex reassigned in law means to have a legal characteristic of sex given, allocated, allotted. It does not mean an individual actually changes sex, as we all know. The gender recognition act is a self referential document, it talks about the law in relation to itself and how it interacts with other laws. It is describing the law, not the person. It says the law will assign you this status, and how this assigned status is treated under this law and others.

You can’t protect non binary gender identity using sex based legislation.

You could protect all people with both sex based and gender identity based legislation that didn’t conflate the terms ‘sex’ and ‘gender’...

Trouble is suggesting this is transphobic because TWAW although this doesn’t make sense because if TWAW then transphobia doesn’t actually exist because trans doesn’t exist...

I think the third point, more measuring of discrimination and why, is helpful, but only as long as it applies to everyone.
For example:
Sex: male/female
Gender identity: insert whatever you like
Do you feel that you were treated with dignity and respect in X workplace/hospital/organisation?
If no then please describe your experience.
Simple, open, and inclusive. Any patterns of discrimination will be picked up in the analysis and can be acted on.
