Scotland Yard is to review hundreds of rape, child abuse and sexual assault cases after a second prosecution collapsed in a week due to an evidence blunder.

Well whilst we don't want anyone languishing in prison who is innocent. We must hope that broadly speaking the judicial system gets it right on the whole, and thus prove miscarriages of justice are vanishingly rare. If the police/cps have systemically failed to get their ducks in a row this will prove catastrophic.

I suspect it is going to end with a drop in rape convictions in 2018 and then anonymity for all.

I'm going to play devil's advocate on this and I reckon that a lot of the review CASES, not convictions, are to do with MALE rape and sexual assault.

This isn't an admission of wrongful prosecution. It will not lead to major hand outs in compensation.

As both Cases that have collapsed involved female complaint's(through today's might not have been reported by the 14 year old girl herself).

There are often delays in passing on evidence in all types of cases but it is notable that the media are focusing on 2 rape cases and the injustice for men involved, almost with an inference this can be generalised for rape cases.

I admit I don't know much about this but I have concerns.
If a women has had sex and enjoyed it, can she not then be raped by that person, as she enjoyed it before?
Where will that leave marital rape cases?

Or am I misunderstanding ?

bebanjo I think the point of the case was that this woman said that she was asexual and never ever wanted to have sex with anyone. And so the only reason she had sex with him was because he coerced her into it.

Which was why it was a number of rapes and sexual assaults - basically every time they did.

The texts were her talking about enjoying sex, enjoying sex with him and pestering him for sex. Thus implying that she isn’t asexual which was the crux of the case.

It is a real shame really as if it had been true and there had been a successful prosecution then it would have drawn a decent line in the sand about what consent actually means.

bigolenerdy I didn’t mean that it was a shame that she hadn’t been raped. I meant that with all the cases out there of coercive rape where the victim will never get justice it is a shame that the police managed to fuck it up so badly. Had they contacted the CPS with the info at the right time then the CPS would have declined to prosecute and this would not have become a big deal.

Now we have every convicted rapist in the country claiming that they are innocent just like Liam Allen.

The integrity of our justice system is important and the police not disclosing evidence which is relevant is horrifying.

What is important to note, and isn’t coming across in the media or in the decision to review only rape cases, is that this is a potential problem is all prosecutions, not just those of rape/sexual assault. Such cases shouldn’t be singled out, in my opinion.

Interesting also how all of a sudden it's now being accepted by some that sex with a 14 year old is not wrong if they didn't know they age when previously these people would condemn that and not accept that as a defence even if the underage person admits their lied about their age.

And now with Samuel Armstrong being cleared they will certainly be a major political campaign in 2018 which might succeed through getting such law change through parliament perhaps might be the way it doesn't happen.
