I'm appalled at the reporting today of the Liam Allan rape case, in which the prosecutors offered no evidence so he was found not guilty. If I understand correctly it happened because thousands of messages from the woman had not been handed to the defence. The messages showed her asking him for casual sex and telling her friends how much she enjoyed having sex with the defendant. The CPS said they meant there was no longer any reasonable prospect of a conviction.BBC radio implies the messages mean he is innocent. The Mirror (I know) goes so far as to state they prove his innocence. Have I missed something??! So rape within a sexual relationship is not possible now?Partly I'm venting but would also like to hear from any legal experts if I have this right. The CPS saying there is no expectation of a conviction is to do with them assessing how the jury would react to the evidence- possibly also that the not handing the messages over was enough to invalidate the trial?
