How can the feelings of a supposedly more mature now-adult trump a vulnerable 12 yr old who has been raped?
Was my first reaction.

On reflection, if we found out that an at-the-time 16 yr old was in a 'relationship' with the victim and had sex with her three times, still making it rape, it would slightly less abhorrent I think.

I am so relieved other people agree with me.

I don't care what other unknown facts there were, thenjudge's motivation is clear. He thinks the rape and murder of the rapist's sister was a significant factor in his crime against a 12 year old who is clearly traumatised. If there were other mitigating circumstances then he should not have used the reasoning he did.

There must surely be some way to kick up a stink about this?

Surely force has very little to do with it, besides deciding exact sentencing (ie 5 years vs 8 years in prison say, rather than prison vs no prison) - if she was too young to consent she was too young, for good reason! Even if they'd been in a relationship she was too young to agree to that, that's the point - same as if a toddler wants to marry their own dad, they don't get to decide. Really hate the subtle victim blaming involved in 'well if she wanted it it's not as bad' (accept there are grey areas like a nearly 16yr old with a 16yr old but this isn't one of them).

It was rape because it was forced and because she was 12. There's other stuff out there about the crime which clearly shows it was forced but there should be no sliding scale of rapeness when you are talking about a 12 year old and a man who admitted to what he did. FFS.

I apologise that my post sounded victim blaming.
I was more trying to imagine a scenario that could have ameliorated the judge to make that decision.
In the subsequent link there were obviously no mitigating factors, and the feelings if this man are obviously more important than a vulnerable 12 yo victim.
Disgusting.

It's obviously a terrible thing to do anyway, but the crime is made more disturbing and harder to understand, not less, as the brother's reaction to his sister being raped is to do the same thing to another girl. That shows some very odd thinking.

I am not sure if I have got that correct, but I am sure there is somewhere as the public we can go to ask for this to be reviewed.

I have read several articles in this to try and understand the judges logic and failed every time. The rapists sisters awful death should have no impact on justice for a child.

If his sister being raped and murdered made him think it was OK to rape someone then that is truly scary.

Very fucked up logic. Dangerous too.

Poor girl got no fucking justice whatsoever. Angry she has been completely let down.

I'm heartily sorry for this beast's sisters shocking and devastating murder, and rape, but why should this poor young victim suffer for their crime. Why does this mean he should get away with rape.
His sister was raped so he did the same to someone else. And the terrifying thing is he's out to do it again. I'm not saying its going to happen here, but its no wonder. People take the law into their own hands because I'm telling you. If this were my child he'd violated and got away with it. I'd be baying for his blood. I'll make no bones or apologies about it.

Yet again, a traumatic event in a males life is made into an excuse for the horrific actions he takes against a female.

That poor girl has been made the victim twice, once by her rapist and again by the justice system.

Christ, I just read that link Sunny, it was an actual violent rape.

(I know all rapes are a violent act). I guess I was searching for a possible reason why the judge thought leniency was appropriate, eg he had no idea she was 12 and it was 'consensual'.

But no, just absolutely outrageous.
