It's a really shocking story. If only the woman who was raped was aware of the attitude and levels of evidence required before going to the police.

I just don't know what you do with countries that behave like this, and there are so many of them. Especially given that the situation in countries like the UK are still only a few steps up from this. It seems so entrenched, it's going to be such a long road and I often wonder if there is any possibility of ever getting there.

I think the following paragraph quoted from the BBC News article link in the OP is worth emphasising, to show how what rape victims have to deal with in the UAE:

"According to the Emirates Centre for Human Rights, UAE law states a rape conviction can only be secured after a confession or as the result of testimony from four adult male witnesses to the crime."

Well we haven't reached equality yet Specialsubject in lots of areas. Including rape cases - only 6% of rapes ever end with a conviction.

So sad for that woman.

Purely from a legal academic viewpoint the '4 male witnesses requirement' implies they are prosecuting for zina adultery (the only use of it in the quaran is where someone has accused a woman of adultery and the accuser is forced to provide 4 eye witnesses or else be charged with slander). If adultery is proved by these witnesses the sentence is death for both.

The treatment of rape as zina stems from 1979 when much of the shariah laws were given legal statute by the dictatorship in Pakistan as part of the Hudood Ordinance. It is now cited as the main reason for 80% of women in prisons in islamic countries being held.

There are several islamic scholars in Dubai currently arguing that rape should be treated as hirabah terrorism/warfare citing a hadith where a woman is raped with no witnesses (she is free to go after identifying him, he eventually admits it and is stoned to death) with the lawyers arguing that medical evidence can now 'admit guilt' for him. If hirabah is proved the sentence is death for the rapist.

It seems likely that treatment of rape as a subset of adultery is being used to invoke the 4 witness requirement (which of course can never be satisfied - in no believable circumstance do 4 people watch a rape, do nothing to stop it, then willingly stand up and act as witnesses) and by doing so avoid having to enforce the death penalty for the rapist (who here is also an ex pat).

They (Dubai Authorities) are between a rock and a hard place - either they
hold both in custody and then persuade her to drop the charges when 4 witnesses cannot be found or they put a westener to death which would damage their ablity to attract the foreigners that are their life blood.

Dubai was already on my list of countries to never visit. In fact it's the only country definitely on that list but I would read up on other middle eastern countries before I went there. I really don't understand how it was ever a holiday destination. Not only are they highly misogynistic but they've put people in prison for having a microscopic amount of cannabis on their shoe when they fly into the country. I'd be very surprised if there was anyone in this country who had never had a small amount of drugs on their shoe. We've probably all got traces of cocaine in our wallets for fucks sake.

As he was a work colleague, maybe she will be able to get justice at home? Although, too late to get evidence. Unless the dubai authorities will share? But guessing they didn't proceed as per best practice rape investigation.

So she goes free and so does he.
