Court case features a recording of a rape over the telephone and still the defendant tries to claim it was consensual!

Basically a woman who was being attacked dialled 999 and the details of the assault were thus recorded. This recording places the defendant at the scene and features the victim saying 'no' repeatedly. And yet still the defendant pleads not guilty, putting the victim through the stress of a trial whilst he claims ''I believed her advances indicated that she wished to have sex with me. It was consensual". What the heck? Angry The sense of entitlement, the excusing of horrible violence - she had 33 injuries - just sickening.

I read this just now and it made me so cross - just wanted to vent.

Do we think the jury will find some way to believe him? She had been drinking and she doesn't remember what happened after all. That's a couple of straws for them to grasp at.

It just shows how rapists know how easy it is to get away with rape. They can claim consent against all the evidence and they'll generally be believed by juries.

It was depressing to note the daily fail report that the defendant "admitted" she'd been drinking.

Like drinking alcohol is something shameful and wrong, that you don't state you've been doing, you admit to.

If it was consensual he wouldn't have had to inflict injuries to make her submit, would he? So I suppose she must have consented to be injured as well. I'm told some people like things like that Hmm

And er, doesn't the law on rape state that if the subject is intoxicated she is not deemed to be able to give informed consent? So actually the drinking should be more of an argument for the prosecution than the defence.

Annie - in a case where a woman saying 'no, no' on a recording can still be claimed by the defence to be consenting then any ridiculousness may believed I think.

Although the % of convictions in cases which actually get to court is comparable with other crimes so there is hope.

I just remember that case where the bloke got off as he said that he was foreign and didn't understand the word "No". And all the others...

Update - he was found guilty. In his defence he claimed that she had performed a sex act on him and in his revulsion he had hit her - and inflicted 33 injuries Hmm. Thankfully the jury weren't convinced and found him guilty of two charges of rape and attempted rape. A third charge of rape was withdrawn for legal reasons.

Sounds like the victim has been attacked twice tbh - both physically and in court.

Thank goodness he was convicted. Feel very sorry for the victim and both ordeals she had to go through because of this prick. Sad

I've been googling to get the updates and the only national which picked it up at all was the Daily Mail which had the first story. I agree it is an outrage. Hopefully he will get a substantial sentence next month.
