Actually, he spoke to the Sunday Telegraph. The Daily Fail then re-reported their story.

Can't say I really have an opinion on the case itself. I don't know enough details to judge.

Surely everyone who sues in the civil court know that if they lose they could be liable for the other side's costs?

I don't understand why he would launch an action against the alleged victim if he'd already lost against the Home Office.

He was cleared of rape on appeal so your thread title is inaccurate. Also, as another poster pointed out the telegraph ran the story first.

He probably launched the action through poor legal advice and a desire to clear his name.

Attitudes to rape in this country are diabolical but inaccurate reporting and gossip about cases makes it worse.

You have no idea what the full details of the case are but you have retried and re convicted someone who was cleared.

I think that sentencing for rape is too lenient in this country and feel that the prosecution process is far too weighted in the favour of the accused but in this case a person has been cleared.

Well, he took a gamble (every single lawyer in the land would have warned him that he was liable for the other sides costs) and he lost. The same can be applied to any individual who sues. I can't say I have any sympathy for him.

A jury found him guilty. That is almost unheard of in rape cases. His conviction got quashed on a legal technicality- it doesn't mean he's innocent.

Thank you dittany for posting that. God, how I WISH I had the skills to hack into the Daily Mail and make sure every time someone clicks on a misogynistic article like this we could make sure the other side of the story comes up instead.

Rapist or alleged rapist?

I read this earlier and was going to post but couldn't really make head nor tail of it, so great detective skills, dittany.

He got his conviction quashed on a technicality and only didn't get retried because of time served, is that right?

How fucking stupid of his lawyers not to realise that it is the Crown that is on the other side of a criminal trial. That's what the "R" means in R v Whoever.

Women have won civil cases against rapists in England and Wales before, I think there have been very few cases though.

I'd like to see a campaign for funding for civil claims against rapists.
