How does secondary school application work with an EHCP in Year 6?

Hi.
Can someone explain to me in simple terms how the process of applying for secondary school works the an EHCP? Ive heard that many different things that I'm confused. We only have one secondary school in our town. I understand the normal process for applying without an EHCP in place. Some say apply as normal, some say wait for the council to get in touch.
She starts year 6 in September.

If you use the SEN board you'll get a definitive answer.
I thought they did transition reviews in y5 and you named the school then, but maybe not!

Her current setting must hold an annual review in the autumn term. The local authority will.process and amend the EHCP if needed and then consult with local schools to see if they can meet need.

Once they have the consults back they should ask you if you are happy to name X school who have said they can meet needs.

There should be an annual review meeting in the autumn term of year 6. This is so the LA has time to finalise the EHCP with the secondary placement named by 15th Feb of Y6.

As part of the review process, what should happen is:

  1. Updated advice and information must be circulated at least 2 weeks prior to the AR meeting.
  2. Then you have the AR meeting.
  3. Within 2 weeks of the AR meeting, a report must be circulated.
  4. Within 4 weeks of the AR meeting, the LA must inform you if they propose to amend or not. For phase transfer, they will have to. They must send the amendment notice/draft/notice of amendment/proposed amendments (whatever the LA/you want to call it) at the same time and you must be given at least 15 days to comment on the amendments and state your preferred placement. At this point section I must be blank.
  5. Then the LA must finalise within 8 weeks of sending the proposed amendments, so max of 12 weeks from the AR meeting. This must be the 15th Feb.

LAs often act unlawfully. For example, some try to hold the phase transfer review in the summer term of Y5, some try to insist you need to submit a form by a certain date (which may even be before the AR meeting), some say you have to give 3 schools, some say you have to give a mainstream school even if your preference is special school, some say you can’t change your mind if you did submit the form prior to the AR process.
