Leaving but not well enough to work the last day of term-must a sick note really cover August?

Just this really-I resigned my position in January to leave at the end of the summer term as I’m relocating. Unfortunately I am now on sick leave and it’s unlikely I will be able to return to work in the next 2 weeks before term ends. HR have told me if I don’t show up for work on the ‘last day of term at least’ then I will have to have a sick note for August or ‘you’ll have broken your contract and will have to pay back the last month salary’

does this sound correct? Union website says if you are unfit for work over the holiday a sick note must cover it but I will be fine to work I’m a couple of weeks it’s just that the school is closed to the teachers in August. Is it the same rule if your contract ends in August

This is an interesting question. Surely you could be ill up until the end of term, and then feel better in the holidays, so why would you need a sick note in the holidays if you are better?

But I get that the school might assume that you are still ill, and would need to continue providing sick notes to get paid over the holiday. Anyone know?

Union rep here. AFAIK, there is nothing to stop you reporting fit for work on the first day of the summer holiday. But you would be wise to take Mrs Hamlets's advice and speak to someone in your own union.
