I’m currently working at a private school and was after some advice regarding the notice period for resignation and potential contract issues.
As per my contract, I am required to give a term's notice. I interpreted this to mean that if I handed in my notice before the May half-term, I could be released by the October half-term at the latest. I recently interviewed at a state school, and they offered me a job. Since it’s a state school, they only require a half-term's notice and are keen for me to start in September.
During the interview, I mentioned that I might need to stay until October but that I could ask my current Head to release me early. They said it wasn’t ideal but could possibly make it work until October. However, it turns out I misunderstood my contract, and on informing my current Head, I was told that a term's notice refers to specific dates, meaning I am legally obliged to stay until December. This effectively extends my notice period to almost half a year, which seems unreasonable to me, although I'm very aware I signed up to it!
My Head has said they will try to release me early but cannot guarantee it. I am now in a difficult situation and seek advice on what to do if I’m told I must stay until Christmas. I understand that legally I am bound to follow through with my contract, but I am curious about the potential consequences if I were to break the contract. If I were leaving mid-term with no warning, I know that would be awful, but I am giving more than half a term's notice and would be leaving at the end of an academic year, so wouldn't be leaving the children partway through the year.
Specifically, I’d like to know:
- What is likely to happen if I just leave anyway? I don't particularly want to do this, I should add!
- Has anyone experienced similar situations, and how were they resolved?
- How can I navigate this situation without burning bridges, as I am very keen on the new job and don’t want to lose the opportunity?
