Part time and strike days

I am a part time teacher (same four days each week). I am part of the NEU and took part in the strike earlier this month. I have been told that despite the next strike day falling on my day off my pay will still be deducted. Is this allowed? Thanks.

No. That is totally not allowed. You can’t have pay deducted for a day they weren’t paying you for in the first place.
Have they put this in writing?

babyboo1and2 · 21/02/2023 22:21

Not in writing, heard via a colleague. I have now found the advice from the NEU about it so will use that information if needed. Thanks for responding.

No, totally illegal- you can't strike on your day off, and they can't deduct pay for any activities you did on your day off e.g. picketing, attending a rally etc.

I'd assume your colleague is incorrect/fearmongering BUT I would tell your rep about this ASAP, and if you don't have a rep in school, contact one of your branch officers- you can find contacts here: neu.org.uk/listings/district-contacts

They will happily send your head a sternly worded letter, reminding them of the law, if needed!

Thanks for the responses. I have queried it with the business manager and was told deduction of my pay is intended by the head and has been agreed by the borough HR! I showed the advice from the NEU website and they said they will get back to me. I will email my local union representative if the head continues with this intention. Again, thanks for your responses.

Absolutely not and if there's any doubt, just tell them you're not on strike that day. You can choose which days you strike and which you don't - it's not all or nothing, so they should only deduct pay when you don't show up.
