Are they allowed to not give me my term's notice?

I recently verbally told my head that I wanted to leave as I wanted to stay at home with my kids and that I would give my full term's notice and therefore leave the school in the October half term.

I have not yet handed in my written resignation, but my job has been advertised, closing 25 August and job to start soon after. Can the school choose not to give me a term's notice? I thought the term's notice worked both ways.
Only asking as DH and I have worked out our finances from the October finishing.
Your help is very much appreciated.

I'm not sure you can leave at half term without agreement from the la/governors. Although if you've not resigned in writing then it doesn't count, so you can negotiate before you do anything.

They might be thinking that it would be easier/better to hire a teacher from September and have you doing odds and sods until October half term.

But, yes, the resignation dates are based around 3 terms, not six. You'd hand your notice in now to leave at Christmas.

Sorry, yes at my school you only have to give a half term's notice. what I meant to write is that I was happy to complete the school's chosen length of notice.

It sounds like you're not in a state school so will depend entirely on your contract. What did they say when you handed in your notice? Do you have anything in writing re end date? From the school's point of view, it would be better to employ someone from September, so, yes, it sounds like they are planning to use you for cover etc for the remaining weeks - you'll need to ask them.

Better for the children to have the same teacher all year. If you were in a MS state school, you'd have to resign at half term and quit at Christmas. Talk to the school about what you'll be doing for the 7 weeks.

If you're in an independent
school or not in England then ignore this. If you are in a state school in England then if you resign at any point after the 31st of May then the earliest you can leave is Christmas. The school may choose to release you earlier but schools don't have fixed notice periods you would be expected to stay on until then. If you want to go before Christmas then I suppose the school can ask you to leave at a time convenient for them (like when your replacement wants to start). They are under no obligation to let you leave until December. People who would also like to leave in December have until 31st October to hand in their notice so the notice can be as little as half a term but anyone wanting to leave after 31st May also has to wait until then to leave.

If you haven't handed in your written notice yet they can't advertise your job, simple as that. Get on to your union. Until they have it in writing you have not resigned.

A colleague of mine did this in the last term. They advertised her job before she'd handed in her notice. The school had to withdraw the advert and then put it back out 2 weeks later once she had given her notice in writing.
