Spring term resignation declined...

My DH is a primary school teacher and has been offered a new job not in teaching, to start as soon as he is able to. According to all the unions, teaching guidelines online etc the last date to hand his resignation in for the spring term is 28th February, although he may be required to work until 30th April (which he has already said is fine). He has spoken to the deputy today who has just phoned and basically said that they will be declining his resignation as he has missed their date, and he is required to now work until the end of the summer term, due to missing their resignation date.
Is this even allowed? They have said he must work until the end of a term, so he said he would work till 27th March then leave, but they said he is too late to leave.

I doubt they can require any more notic, and they definitely can't decline a resignation!

They're wrong. Assuming he is employed under School Teachers' Pay and Conditions (burgundy book), then the last date for resignation is the 28th of February, giving a last day of service of 30th April.

Whether they accept it or not is irrelevant.

Usual date would be the 28th. Many schools prefer the Friday before half term (which might be the date the Deputy is referring to). Check with his union. Is it a LA controlled, Academy or Free school?

Make sure that he emails his resignation as well as hands in a letter, so that he has proof that he resigned on or before the 28th Feb.

It's just a normal council run primary school! I didn't think it sounded right! I'll make sure he emails his letter to the governers, head teacher and his phase leader. He's going to contact his union in the morning too. Thank you all!

I think they are just panicking and trying it on to delay things. If they piss around and it gets to Monday, they can legitimately say that it's too late.

Get him to email the head and COG tonight to say you've checked with the Teachers' pay and conditions and still wish to tender his resignation. Say he'll be contacting the LEA for further clarification, but to state his last working date as xxx.
