Rescue foster cat dilemma - advice?

Wondering what people tihnk I should do. I'm feeling quite torn and upset about it. Sorry its so long.....

Basically I found and rescued what I thought was a stray cat a few weeks ago from a street near me. Very thin, covered in wounds and scabs and wobbly in the back legs.

Got it scanned and he was registered to a small local cat rescue. They asked me if I could foster him while they looked into it, as being chipped to them meant he might have escaped from a foster home at some stage. He was treated for fleas and worms at the vet (I paid, not the resuce) as he was scratching so badly & making the scabs bleed (turns out it's likely he has a flea allergy, so I've now also paid for him to go on steroids). Vet says he also needs dental work and probably has arthritis too.

Anway the rescue has been contacted by the 'owner' he was rehomed to 6 years ago. ('Owner' obviously knew chip had never been transferred over). Rescue were considering not giving him back because of his condition and because owner lied to them about cat being registered with a vet ang getting him treated there. This came out when the rescue asked for permission to get the vet records and there aren't any. From his weight and condition it's clear they've not been feeding him properly (he's put on weight and coat looks so much better since I've had him) or regularly treating for fleas & worms, presumably not vaccinated either.

Rescue person says at first the 'owner' started off upset and crying, saying how much they love the cat and asking for him back, but now has been harrassing them with constant messages.. So I've now been been asked to return him.

Initially I was willing to do so (I already have a cat so keeping them seperate is difficult and I feel guilty keeping him mainly in the spare room, with only ocassional roaming the house when i lock my cat in bedroom). But I can't really keep this cat long term, i don't think mine will accept him and he'll be expensive (I've already spent £100 on him!).

But my dilemma is that the cat has obviously been really neglected. I've been getting really really stressed thinking about him going back to people who have already shown they won't look after him properly. But Rescue are reluctant to say no to owner because they are being aggressive (family members are also messaging as well).

What should I do? I'm so confused!

If I refuse to hand him over I'm not sure what rescue can do - they have my number but not my address. Owner doesn't have my name or contact details. Could owner take the Rescue to court for ownership? Given he's chipped to the rescue would that be proof they own him not this other person, despite the previous rehoming, (which i assume there must be some records of).

What would you do with him if you didn’t return him to the rescue centre?

You don’t need to answer the phone to the rescue centre.

How kind you’ve been. I would not want to return it to the rescuers / previous ‘owners’.
Do you think there’s any chance your cat & this one could learn to tolerate each other in time? But the risk with keeping it is that if the previous owners are local to you they could spot the cat & pinch it.
Can you change the chip details to your name without alerting the rescue centre? If so I think I would do that & then take it to a rehoming centre far away.

So the rescue staff want to hand this cat back to a home they already know to be neglectful because the cat’s owners are bullying them…I wouldn’t say that boded well for the poor cat.

I’d tell the rescue staff to tell them he slipped out and hasn’t been back. But that the vet’s bills for him now amount to £x and you would appreciate being reimbursed.

Thanks for the replies. I really can't keep him, it just won't work sadly. He'd have to be an indoor cat like my current one and it's just too much to take on, even if they eventually got on. I am happy to foster him a bit longer if found a new home though.

@FuzzyWolf @Greeniscalming You can only swap a chip if the registered owner (the rescue at present) either gives consent or doesn't respond after a certain time period when contacted by the chip database company. So if I just kept him and told Rescue a fib like him going missing, it wouldn't work as they'd be contacted once I applied. Hence I couldn't get his chip changed to me or anyone else who might be happy to take him unless they agree.

@CatChant Ideally the rescue wouldn't agree to give him back and would try to rehome him to someone else. And I do have some sympathy for the dilemma they are in too. I don't think its just about the owner being a bully, so much as that the rescue are so busy. This cat is just one of the many they are trying to help and he is sucking up a lot of their time. He's not abandoned or abused or injured like many they must see. While he has a lazy owner who's not looked after him as well as they should, he does have at least have a home and people who say they love him. Maybe this would be a wake up call for them? I'm also guessing the Rescue might be thinking he'd be hard to rehome with ongoing medical needs. Plus they are small so there probably aren't funds for any legal battle - if owners did go that far - and that might be a concern too. (I'm treating what I've spent on him so far as a donation).

I have until the end of the week to decide what to do! Will ask again if rescue will consider refusing to give him back and see what they say.
