Sales Contracts - is this reasonable ?

  • Breeder can repossess puppy for £1 if they decide it’s not being looked after properly.
  • Breeder gets first refusal to buy back puppy for £1. I can’t sell or sign over to another party.
  • In both cases above, if they sell puppy on for more than £1 they forward me the difference ‘less kennelling expenses’ (not quantified)
  • I can’t show puppy without Breeder’s expressed permission
  • I can’t use for either public or private breeding.
  • Breeder retains the right to use my dog for up to 2 breedings (2 each time) without any charge applied
  • If I have any litters myself they are to remain unregistered (KC) and I can’t sell or rehome them.
  • Puppy must always be airfreighted where that is the quickest option
  • When puppy/Dog dies I need to inform Breeder and provide written confirmation from a vet as to the circumstances
  • Puppy must never be neutered
  • Puppy must never receive vaccinations beyond the initial course which will be completed before I collect puppy
  • Puppy must remain on current diet
  • Puppy must not be treated for worms/fleas/ticks with medicine (Only natural products)

Puppy is £2k

Thoughts on this as I’ve never come across these stipulations before ?

Reasonably standard to request that you first contact the breeder regarding rehoming if you can no longer look after a dog, and to endorse a pedigree 'progeny not for registration'.

The rest is batshit and the puppy will be full of worms if all they use is herbal crap.

Very,very odd. Usual stipulations are (1) no breeding without permission and (2) you have to offer the dog back to the breeder before rehoming. The rest are bizarre.

“No.”
“But you signed this random piece of paper saying you would.”
“And...?”

Or change your phone number.

She does sound bonkers but there’s no way she’ll be able to make you do what she wants.

First refusal for rehoming is normal and desirable.
Endorsing pedigree for breeding is not uncommon, some breeders do not want certain blood lines mixed with theirs for health reasons.
Otherstuff - batshit.

Really good breeder will ask always to be consulted, at the very least, if the dog is being rehomed, and be willing to take it back.. For breeding means any progeny of the dog cannot be KC registered unless the breeder has lifted the endorsement (they should be clear about the circumstances under which they will do this - good health scores, or good health scores + proven in work, or whatever).

Some of the stipulations in that list take control freaky to a whole new level.

I don’t know about buying puppies as only had rescue dog before, but that first rule together with the rest would make me worried that the breeder would try and decide I wasn’t looking after the puppy once it was breeding age and buy it back for £1. I’ve never heard anything like it before. Plus it sounds a bit like you’d be looking after his breeding dog rather than buying your own puppy.

Some folk seem to think printing stuff on a bit of paper supersedes the law. It doesn't. If you buy a dog it's your property and (in most scenarios) your responsibility. End of.

I'd walk away, they cannot legally stop you from showing the puppy. They can put restrictions on breeding, but honestly that breeder sounds crazy. Surely once they leave the breeder it's up to you as their owner how you feed, vaccinate and worm them? That price is also ridiculous.

I’d be paying £2k for the privilege of housing her dog.
I’d always be worried that if I decided to do any of the things ‘prohibited’ that she’d come an repossess my dog - even after years of ownership Sad

Gosh that's madness. Some of it isn't that far fetched but most of it is. My bitch is endorsed, but the breeder always said if I wanted to breed and had the health tests done then they could be lifted at a later date. I have no plans to breed though, already got three dogs, don't need another eight Grin

Legally they're non enforceable so she couldn't but yes it has the potential to be a stressful nightmare

Rubbish. After sale the breeder has no say as to what you do with your dog. Implicit in a sale of anything is the handing over of all rights to the thing. If you are in any doubt get a free half hour of legal advice. It is despicable of any breeder to attempt this sort of scam. Another type is to say you must buy the food from them. That is twaddle too. For goodness sake don't sign.
