My son is 18 and finished school July 2020 he’s been offered uni but didn’t accept and started work more than 12hours per week he live with me. He’s is now applying for a uni for this year and also live in accommodation. So does his father still have to pay maintenance to me from July 2020 to September 2021? Also does he then have to pay maintenance to my son or has my son due to working lost his entitlement to the maintenance?

No his father doesn't have to pay maintenance to you. My ex paid it straight to dd instead to help her through uni.

Your ex does not have to pay you maintenance after the 31st Aug once they have turned 18 and finished school your ex should have paid you up until 31 Aug 2020.
Your ex does not have to provide him with any support while at Uni.

Thank you. As my son has been working for coming up to 12 months he has applied to uni and live in accommodation but not been given a place yet. If he gets a place does my ex pay my son to help him or as he has left education and broken the legal protocol has he lost the right for his own maintenance?

It’s up to him if he wants to give your son any money once he’s at uni. It’s between the two of them.

Give your son what you can afford to, nothing to do with your ex, he does the same and vice versa.

Your ex only has to pay until he’d finished education at age 18, so last year. He doesn’t have to pay anything towards university although the decent thing is to do that. In the same way you also don’t have to legally pay anything towards his university but if parents can then they normally do.
I’m not sure why you’d think he needs to pay maintenance from July 2020 to September 2021; your son is an adult and is working

Your ex has to pay until the child finishes full time education so if he did a course (a'level/foundation) course for a year, he would still get maintenance even when he turns 19.

Wow thats one lucky adult if he gets maintenance while at uni, there are lots of 18 year olds despite parents being together or not are on their own financially when at 18.

If your ex can afford it then great, but surely would be nice if the money is paid directly to

BigGooseyLucy · 29/08/2021 20:53

*paid directly to your son not you
