DSS has not paid speeding fine

Hi all
Hope you cAn offer some advice.

My DSS got a speeding ticket the back end of last year.

He got the letter, wrote back stating would accept the fine rather than the points as he is late teens.

We have since found out he hasn't paid the fine.

He was looking at car insurance last night and saw that his licence has been revoked ( this will be because of 6 points not long after passing his test).

He will lose his job if he has no licence.

Does anyone know of its worth contacting a solicitor as he states he received nothing At all through the post just this initial letter advising he had been caught speeding.

Or does he just need to suck it up and re take his theory and driving test again?

I don't know what he was doing on there tbh.

I've seen his dvla record though today and it says revoked. Not disqualified or banned and there is only the one speeding offence.

I've offered advice it's up to him now to sort out. This will be an expensive lesson for him about taking responsibility. He won't be able to afford a car when he gets his licence back because of the insurance.

We live in a part of the uk where it's particularly high anyway. Lots of insurers were asking for a one off payment and were over 5k.That's without six points!!!

We had similar happen when we asked for the fine and heard nothing. It went to court and were told we had to prove we didn't receive it rather than they prove they sent it. Bloody shambles for the sake of a recorded delivery. Cost us 150% of my husbands weekly wage, 30% victim compensation and court costs. Needless to say we are now almost £5000 poorer Angry

Probably best to seek out a job that doesn't involve driving.

I think employers ought not to employ people for jobs where driving is vital until they have managed to demonstrate their ability to drive regularly for 2 years without accumulating 6 points.

You may find that insurance companies refuse to cover him at all, I'm afraid. Then in future he will have to say he has been refused insurance. What a nightmare.

Also, getting a theory test & then a practical test would take weeks around here.

To get 6 points for speeding he must have been going significantly over the limit.

In any case, as least you know what the situation is and he can get on with sorting out his tests again now.

Yes I understand a previous poster’s concern about proving they didn’t receive rather than the other side proving they did. Legally proof of posting is deemed good service, so it is assumed that it arrived. It is slightly easier in our area as they send reminders so the chances of two or three items not being received are slimmer. There is no obligation to send reminders though. My advice is to keep copies of everything you send off and send them signed for.
