Is this offer reasonable? Re dress damage

I bought a dress from a (to me) high end boutique British label. Full price c. £350, I bought it in the sale for c.£150.

Lovely dress. Wore it twice, in the evening, at home (to illustrate not heavy wear). Not yet washed it. Was turning it outside in, gently, and the bottom of the v neck has ripped, about 2 inches, would rip further if I did anything else. Might be repairable by a professional but never going to be 100 and always a weakness and visible.

I emailed the company, politely, and had to chase to get a response. They've offered me a credit note of £100 and said they cannot refund as it is worn and cannot replace as sold out. Would you be happy with that offer?

I feel as though I am out of pocket for a dress I can't really wear in the same way and that any credit note assumes I will buy more from them, likely spending over the £100 due to their prices.

Not a legal opinion but yes I would personally be happy with that. It's 2/3 of the cost of the dress, and you've already worn it twice, plus you were the one that ripped it - even though you were being gentle, some dresses are just very delicate. I think the company's response is perfectly fair and transparent. Many places wouldn't give you anything. If I were you I'd pocket the £100, repair the dress and enjoy wearing it in the knowledge it only cost you £50

I bought a pair of trousers from a high street shop, cost about £40 (so not as expensive as your dress) wore them once and noticed the seem was coming away on the inner leg. Took them back and was offered a full refund or replacement as it was a fault if the trousers?!

Thanks both. I do feel that the dress cannot have been fit for purpose for this to have happened. 2 hours wear, and turning outside in. Surely I should expect it to withstand that for an RRP of £350??! And it's corduroy if that makes any difference, not exactly flimsy.

How long ago was it purchased? I personally would argue as it doesn't sound fit for purpose. Clothes should last more than 2 hours and you should be able to turn them inside out. It doesn't really matter that it's used, if it's faulty.

Or how did you pay? Might be worth persuing with card company if you used a CC

Yes I'd definitely not give up and down the stairs and claim with CC if paid that way. Legally you are supposed to he able to claim for faults within 6 months usually.

Thank you. You've given me the confidence to keep going. Depressing really, I bought from them as I wanted to support a small British business. Feeling a little hard done by!
