I personally think the first one is too short - and I too am 38 (not quite as tall as you, only 5'7", and a size 10/12 and (though I say so myself) I have pretty good legs in tights I like the second one better (I wore one just like that for my graduation ball in 1991 )

I hate the fact that I think age does have some bearing on suitable dress length...

I think it's better as one gets older to flash legs than boobs, surely?
I am 37, size 8 and I would wear the lace one, deffo. (but then I always had gothy leanings) The first one is only a tad too short for comfort.

Olive I'm sure with your height and slimness you will look stunning in a short dress.
