Can I return M&S jeans after a few months?

Have a pair of Limited Edition skinnies which I love but the zip is faulty!

I've no receipt.

I just want to swap for another pair but will they tell me to do one if I've no receipt?

I think the quality of marks and Spencer's clothes has really gone downhill. Last year I had a pair of cotton trousers that split the first time I wore them and this year a pair that the button came off in the wash, but it had been attached like jeans buttons so couldn't just sew it on. But I didn't get round to returning either, so can't really help with that. Although if you have wore them a lot then maybe I would just replace them.

Pushing your luck a bit, I think.

You could take them to a dry cleaners (one that does alterations) and get a new zip fitted?

Did you pay on a card? If you had the card statement to show when they were bought, you could use that instead.

Good luck - I tried to take a pair of jeggings back 2 days after purchase as the material had started to bobble and look worn after just one wear. The woman really played her face about it, and said it was because my fat thighs were rubbing together when I walked. Luckily I had a pair of the same jeggings on which I'd had for months so I just plonked my leg on the counter and said "same jeggings, worn for months, no bobbling".

If you've had them for a few months then I think I would just take them to an alterations place and get a new zip fitted. I've done that before, it cost less than a tenner.
I've also had them replace a button more than once - as a pp said, the ones that are like jeans buttons and can't be sewn.

Few months is maybe a bit of a grey area. Sale of goods act suggests good need to be of "merchantable quality" and basically be fit for purpose for long as can reasonably expected.

So the question is how long ought we expect to get out a pair of jeans? £200 designer ones? £20 cheapies? They are also well within their rights to offer a repair.

I had a bit of a set to with mamas and papas re a cot bed on this point. Lots of faults developed after the end of its 2 year guarantee. I won the argument that it was an expensive bit of furniture that transformed from cot to bed to sofa so definitely should last more than 2 years and got a repair.

I've done this before at m&s when a pair of jeggings suddenly ripped in an odd place (not a seam) after a couple of months with no receipt. Under the sale of goods act you could claim they were not fit for purpose as a zip should last longer than a couple of months.

Why pay a tenner to replace a zip when you've been sold a substandard item in the first place?!

In my case the woman also tried to claim I was too fat, and I also showed her the identical pair in another colour I was wearing which fit perfectly! Luckily her colleague stepped in and said they'd had an identical strange rip the day before and had refused to refund, but as it was now multiple occurrences they would refund. Always felt sorry for the first customer though!

I forgot to mention, I was left with the impression that M&S are subtly changing their refund policy to be as awkward and unhelpful as possible and avoid giving refunds where they can.
