Claiming 30 hours free childcare

Anyone know how that works when stepparents are involved?

I will likely make over £100k this year but I didn't think this would be considered because I'm a stepparent.

Anyone know if it's joint income? Or only the bio parents? How does it work?

If it's your partner (who you live with) claiming then yes your income will count if it is the other parent claiming then neither your or your partners income will count. Oh it's also the residential parent (ie the 1 who gets the child benefit) who has to claim.
Hope that helps

QuirkyTurtle · 04/04/2022 21:22

There's no court order and no one claims benefits! But thank you for the response x

There doesn't need to be a count order for residency it would be the parent/home that the child stays at the most which with small children is usually the mum

QuirkyTurtle · 04/04/2022 21:53

Thank you! We share 50/50 so I'll have to figure out who has the majority nights this year.

In any case it doesn't look like we'll be able to claim which is incredibly disappointing ha.

I'm pretty sure it's 100k after pensions deductions which might make a difference?

WhyOfCourse · 05/04/2022 06:30

If its 50/50 then they should pay 50/50 on the childcare if they both use it.

TeddyBeans · 05/04/2022 06:30

I live with my partner who's not DS' dad and my entitlement is based of my household. As you're 50/50 it would be based on the household of whoever made the application I would have thought

TeddyBeans · 05/04/2022 06:31

*on

WhyOfCourse · 05/04/2022 06:32

And ridiculously yes (in England at least) it's whoever is applying and their partner's income. Even if their partner doesn't pay a penny towards their stepchild.

Depending on circumstances you can often get a good way over 100k gross before being over for tax once you include every tax deductible.

Don’t forget pension contributions, professional bodies, unreimbursed mileage/subsistence, home office furniture, work from home allowance, gift aid, etc

Once the loss of free childcare and loss of personal allowance are considered you can easily hit a marginal tax rate of over 100% so be very thorough making sure you claim everything you can. If still only just over a charitable donation can be back dated and gift aided after the start of the new tax year once you know exactly what to give to get to £99,999.

Gov website says “You and your ex-partner need to decide who should apply if you are jointly responsible for your child.”
So it sounds like for 50/50, you can choose who applies, although you might need to go through the application process to make sure.

Thanks so much everyone!

And yes I know that both parties should pay for childcare, we do.

Patchbatch · 05/04/2022 08:07

Can the other household apply? If you both pay anyway now a fair way would be that they claim if eligible (its not like tax free childcare where you have to manually do it every month, it just needs revalidation- a click- periodically) and then pay half of the top ups or additional hours etc? Optimistic I know, but even with 50/50 either can apply.

Whatifitallgoesright · 06/04/2022 15:57

Are you saying that you earn over £100k and want to claim free childcare benefits?

QuirkyTurtle · 06/04/2022 16:12

I'm not claiming anything as I'm not the child's parent.

OP posts:
Asdf12345 · 06/04/2022 16:22

@Whatifitallgoesright

The OP is saying they don’t want someone else’s kids to lose their childcare because someone unrelated and with no responsibility to them has crossed an earnings threshold.
