Child benefit for nrp

Just a quick question, if a non resident parent has all their contact time in a chunk (ie 70 days straight) instead of every other weekend are they or should they expect to be entitled to child benefit/child tax credits for those weeks?

No but they should have a reduction in tge CM thry pay due to having the child, on average, more than one night a week.

Only one parent can claim child benefit. That’s the RP. If the NRP has the child 70 days a year and the RP 295 days, it hardly seems fair you (the NRP) woukd claim CB!

Can’t comment on CTC.

I would suggest that you calculate how many nights he has the children for. He should be paying YOU maintenance.

If it is 70 nights he has the kids, I would say..... that as I have the children for the majority of the time - circa 295 and he has them circa 70. You are entitled to maintenance from him and to claim CB.

I can’t believe the cheek of him!

My OH’s pays his EW over £8k in maintenance a year, plus pays extras, plus she claims over £18k in benefits (and he has the kids EOW and half of all holidays). Apparently it’s a ‘pathetic’ contribution from him. He would never dream of asking her for money! I really can’t believe his cheek.

So you get no help from him for 10 months a year and now he needs your help for a couple of months?

Not working and am unsure what benefits they are claiming, I'm.jusy pissed off that they've never offered a penny amd now literally 2 days into contact they send that message amd say they are happy to claim.to save me sending it!!

Be careful though . He may want to be claiming working tax credits on top . Can’t do this without the child benefit.

Tell him to contact cb agency and see what they say ( he can't argue it then)

Because that's what dc wants. They can't claim.wtc as they don't work but I know what you mean as they could (maybe) use it as a gateway.

Tell him the child benefit has gone on the clothes, shoes, electronics etc etc that your DC has presumably gone over to the NRP's with.

yes sorry it is child tax credit but i believe can also affect housing benefit if he isn't getting full benefit.

Put in a cms claim, it will only be a few quid but it will send the nrp a message.

Ah. I think you need to be careful here actually. The Gov information relating to CB explicitly states that you need to tell if

"your child will live away from you for either 8 weeks in a row or more than 56 days in a 16-week period"

which is the case if they are away for 10 weeks. This page may be helpful- it suggests that technically you will get the CB for 8 weeks of that 10 if no-one else claims and longer if you contribute, but if he does claim it could get tricky given the length of stay...

Well they will still be away from you for more than 56 days in a 16 week period won't they, so no, I don't think so...

Off topic but I do get confused about how child benefit works where both parents have 50:50 custody as technically they both have equal costs.
Back to topic, could you ring and ask the CB team for advice ?

Spangly only one parent can claim child benefit per child so in the case of an odd number of DC it's up to the parents to split the CB between themselves. If an even number of DC then the parents can claim for a child/children each.
