Interim court order

badgerread · 18/09/2017 10:53

Is being threatened by ExH for access this Christmas. We are out of the country from 15/12 to 03/01 to which he's agreed and I have it in writing.

What is an interim court order??

Had he applied through the courts with an interim order? TBH that's two full weeks away over the christmas feastives so I can understand that he will want to see dc during them time.

I don't know. I just got an email saying, 'I will shortly be issuing an interim court order for access this Christmas'. We are going to Australia which he's known about for months and has agreed to. He is having the same time next Christmas. There has bren a lot of to ing and fro ing over holiday dates this weekend and he's been throwing his toys out of the pram so I think he's just threatening. Again.

When you say you have agreement in writing, what do you call agreement? What you call agreement might not be what he calls agreement (and what a judge could yet call something else!)

During a 4 year court case my barrister said no judge would order Xmas arrangements. If you have stuff in writing you will both be expected to stick to that. .

I didn't say we had an agreement in writing. We discussed it a few months ago over text. I asked if he was ok with it. He said yes, great experience for the DC and that he would have the same time next Christmas to which I said yes. No official agreement in writing.

Sorry swing, I did say that. I meant in writing, as in by text...

to which he's agreed and I have it in writing

That really did imply that you had an agreement in writing tbh, so I do understand the comments from previous posters.

I realise that hence my apology..

Why is he not agreeing now? Does he have a reason?

badgerread · 18/09/2017 17:25

I think it's because we've been 'discussing' holiday dates by email and he wants the 2 weeks I've booked next summer. It's one of our DC's birthday in August and as he had him this year I feel it's only fair I have next year. He's throwing his toys out as I won't change and starts threatening interim court orders when he knows we're out of the country..

Have you kept those texts? At least that'd be something.

I would just not reply for now.
