Apparently 50,000 letters have gone out but I'm assuming these are only a certain group as we've yet to receive a letter?
Has anyone received one yet?

Apparently they are gradually changing all cases over and it will not be completed until 2017.

Unlike most people, we will be much better off financially on the new scheme so can't wait to get the letter!

Icantstopeatinglol · 24/05/2014 12:37

We've only got 2yrs left so I've a funny feeling we won't get a letter and they'll just leave our case to run it's course.
Just think 50,000 isn't actually that many?

Isn't many at all. As far as I know over the next 3 years they will send out X amount of letters each month giving 30days notice

newbiestepmum · 24/05/2014 18:05

Apologies for my ignorance but what are the changes?

Icantstopeatinglol · 24/05/2014 18:10

Basically, they want everyone to try and make private arrangements. If this can't be done then it costs £20 for the application then the nrp will pay a 20% fee and the pwc will be charged a 4% fee.

How does it work with CB in a 50:50 arrangement? Does one parent just claim it or can both parents split it?

pennypinchingnamechanger · 24/05/2014 21:34

Only one parent can claim CB in 50:50 split. It will
usually stay with whoever currently has it at the time 50:50 starts or both can make claims and Cn office decide who is more worthy :)

Under new rules no maintenance is payable where care is shared absolutely equally

klh99 · 24/05/2014 22:27

Are you sure about no maintenance if 50:50 pennypinchingnanechanger? I remember hearing that it may happen at some but I can't find any evidence or information to say that it will be.

TheLowestFormOfWit · 24/05/2014 22:32

Thanks Penny.

Foxeym · 24/05/2014 23:17

And also they don't take into account ctc anymore in calculations

pennypinchingnamechanger · 24/05/2014 23:27

Yes klh99. Absolutely sure. Only in cases where care is shared equally. So if the RP takes greater financial responsibility for everything then 50:50 nights won't be enough. Only if everything is shared equally.

pennypinchingnamechanger · 24/05/2014 23:31

If you look up on the .gov website there's a booklet you can download called "how we work out child maintenance a step by step guide" it contains all the new regulations for CMS cases new or when passed over from CSA. Page 29 is FAQ and states when care of a child is shared equally no maintenance is payable. Black and white nice and simple and clear. Yay!

daisychain01 · 25/05/2014 11:45

Just to add to the 50:50 shared care situation.

Where there is an in-force court order which stipulates that the CSA will not be involved and that the shared care is a 50:50 pattern, with each parent taking 50% of the financial burden, that will trump all. Where it is an informal arrangement, 50:50 will likely still need to be proven in the event of a dispute.

In other words, even if the real world situation alters to allow for the growing maturity of the child (eg if the child was 7 or 8 at the time of court order and the court order lasts "officially" until 18, the child may well want to deviate from a prescriptive pattern) the Court Order will be the document that will be the deciding factor. Having this will prevent any malicious attempts to manipulate the situation, then turning round and trying to demand money through the authorities. Of course, if the parents cooperate and decide themselves to change the financial arrangements, they can do that. Often the court order is in place because of lack of cooperation!

CSA these days is about "empowering" and to shift the responsibility back to families -finally the government's over-simplistic theory about how the CSA will solve all the problems of the world, has fallen apart after all these years!

klh99 · 25/05/2014 12:11

Thanks penny.
I can't believe there is only one sentence about it! What about if it takes 2 years for them to change you over to the new system? That's not really fair is it?!

rach2713 · 26/05/2014 00:36

I rang them up the other day there just putting new people and people who took out a case as far back as 2012 on to the new system but everyone who has a csa account will go on to the new 1 and get given 6 months notice before. There trying to make it easy so no1 loses out on money but in some cases like mine I don't have contact with ex just through csa to get payments
