DD refused access to sensory room, is this legal?

DD13 is on the SEN register due to autism, she has an arrangement where she asks the teacher for SEN support and she can go to the sensory room herself.

Today she asked to go but was told there's a new system in place and she has to wait for someone to collect her. Nobody came all day!

I've obviously made a complaint to school but don't expect a reply as their senco is usually non responsive.

Is this a breach of the law? (No EHCP but she is diagnosed)

If the SENCO ignores you, go higher. The school needs to make reasonable adjustments and they must make their best endeavours to meet DD’s SEN. They clearly didn’t manage that yesterday.

Have you considered requesting an EHCNA?

Yes we are going down that route but only just started. I will definitely take it higher if I don't hear back from the SENco, it's really frustrating that they don't communicate.
