PIP and Universal Credit application (50/50 parental responsibility)

A very niche question…..

my son gets PIP. I am his nominated person so benefit gets paid to me and I use this money for things he needs.

His Dad (my ex Husband) is applying for Universal Credit and is asking questions about the PIP - he has had limited involvement in diagnosis, benefit claims for DLA or PIP, medication etc I do all of that so he needs me to tell him what element of PIP our son gets so he can claim for having a “disabled child” on his UC form. This is the claim form language not mine.

if he claims UC and gets extra on the back of our sons PIP, which is linked to me / him at a different address, will the PIP be affected?

I don’t want anything to impact our sons PIP as he needs this money for many of his care needs.

we technically have shared care of our son, 50/50 although he spends slightly more time with me. I’m emergency contact, registered address for GP etc.

any advice would be appreciated!

The UC disabled child element doesn’t affect PIP payments.

However, if you claim UC and DS is on your claim, your ex can’t also have a child element and a disabled child element for DS. You can’t both get the carer element for DS either. And if DS (you as appointee) claims UC in his own right, your ex cannot have a child element/disabled child element for DS either.

Thanks that’s really helpful. I can’t / won’t claim UC as I am working and neither with my son as he’s in education still.

do you know if my status as DCs appointed person, would be affected by my ex claiming UC disabled child element?

Depending on your earnings, you may still be eligible for UC.

Some disabled DC in education can receive UC in their own name, which is why I mentioned that.

Your ex having a child element and disabled child element for DS on his UC claim won’t change you being appointee.
