Disabled Child Element on Universal Credit

My DS is 19 soon and is doing a lvl 1 course at college. He is going to do lvl 2 in September. He currently receives high rate PIP and I receive Carer's Allowance. UC say that he will no longer be considered a dependent at the end of August so we will no longer get the child element. UC didn't answer my question about whether thd disabled child element would continue. Does anyone know?

The disabled child element won’t continue once the child element stops.

Thanks for that. I don't get the carer's element on UC, will I get that when we are no longer in receipt of the child elements?

You can get the carer element now assuming you aren’t also in receipt of the LCWRA element (you should request the carer element is added and request it is backdated). That can continue even when you don’t have a child element/disabled child element.

Thanks, I'll ask them. One more thing, if you know, can we still get child maintenance payments from his DF or will that be taken away as well? Am currently unable to work and we don't want to end up on the breadline.

As long as DS remains in approved education or training, child maintenance can continue until DS is 20. It is sometimes possible for it to continue after that via a court order.

When DS is no longer eligible to remain on your UC claim, he, or his appointee, will be able to claim UC in his own right. The rules for disabled young people in full-time education are quite complex. In preparation for the move to DS claiming UC in his own right, has he or you as appointee made a credits only new style ESA claim to establish LCW/LCWRA? If not, you should do that. From the September following the young person’s 19th birthday, it can be possible to claim without doing that first, but it can sometimes be easier to do it anyway. This Contact booklet and this Contact page explains more.

On a side note, as a carer to DS you can be disregarded for council tax purposes. Unless there is anyone else in the house this then means you would be entitled to a 50% discount because there isn’t anyone else in the house eligible to pay council tax. Are you also in receipt of council tax support/council tax reduction?

As a carer to DS, you could still be disregarded for council tax purposes. That would mean you would get a 25% discount because only DD would be eligible to pay council.

my daughter ( recieves enh pip 4 evryday -standrd for mobilty ) turned 18 in dec 2024 - I stopped recieving the child element and the disabled child element back in may 2024 after she finished college
UC are now do a validation check. now shes 18 and works (8hrs) am i entitled to any thing threw UC for her ?

@Turts73 you aren’t entitled to the child element or the severely disabled/disabled child element for DD.

DD, or her appointee, can apply for UC in her own name if she has savings/capital of less than £16k. Although depending on her earnings, she may not receive anything. If she is unable to work more hours, she will need a fit note and to have a work capability assessment route.
