Eotas for 14 year old with Irritable bowel disease

Hi. I'm trying to get an eotas package for my child with has IBD. His main issues are fatigue, upset stomach, constant loose stools. He is in Nappies. All this is worsened because my son has moderate-severe autism, limited verbally and flight risk. He quickly grabs other children's food that will worsen his condition. Also, the food provided at school always contains ingredients that aggravate his IBD symptoms. Not only that, he refuses to eat packed lunch at school and will go without food all day.
He also has anxiety and is set off if he sees other kids distressed. His anxiety is expressed by nervous laughter so staff dont take it seriously, they assume he finds it funny. But he will cover his ears and crouch down to fetal position.
I know my son needs an eotas but I need ideas on how to prove it. Thank you in advance.

Where are you in the process? Does DS already have an EHCP?

Have you got evidence (e.g. ed psych, OT, SALT, medical consultant, psychiatrist &/or clinical psychologist) it is inappropriate for provision to be made in a school?

Yes he already has an ehcp but hasnt been assessed for years.
I am in the process of formulating the evidence but don't know if the evidence will be strong enough to warrant an eotas. I am booking a private OT to assess him at school but I have his medical evidence, however the doctor will not say where he should be educated, he can just describe the symptoms and treatment of his IBS.
The hearing is in 11 months time.
In the meantime I am tempted to take him out of school as I don't believe it is beneficial for him to stay in school until the hearing date.

Personally, I would not deregister and EHE. However, it doesn’t mean DS has to attend school if he isn’t able to. If DS isn’t able to attend the LA has a duty to ensure he still receives a suitable full-time education and anything detailed, specified and quantified in F. If you EHE, the LA will say you are making suitable alternative arrangements thereby relieving them of this duty. They then don’t have any impetus to concede the BFI appeal.

You need evidence it is inappropriate for provision to be made in a school. So as well as OT, consider ed psych. If you can afford it then move to considering SALT, psychiatrist &/or clinical psychologist and independent social worker.

Is DS under consultant care for his IBS or IBD (your OP says one, second spot says the other)?

Yes we had to see a private Gastro specialist as nhs have ignored his symptoms for years. So he is receiving treatment for IBD.

Also, i will not de register from school, but every time he goes back he regresses.

Make sure you use IBD rather than IBS because they are different diagnoses.

If DS isn’t able to attend, you don’t have to force him, but don’t deregister.
