Social Services want Best Interest Meeting

Hi, Social services are insisting with a Best Interest Meeting for my Autistic Adult Daughter where she should live, I have pulled her out of a supportive living House before she was actually meant to move in cause of concerns it was making her very agitated and she wasn’t safe cause there are 2 other service users there who have worse needs than my daughter, I’m Not disputing Supportive living , just not there, her needs have now changed, she’s not as bad as she used to be cause her meds have now reduced and she is calmer in herself than what she used to be like, am I within my rights to go for Deputyship at this stage as I don’t want the social services taking over my daughter as I have brought her up for 27 years and I know her best interest, thankyou

You can try, but unfortunately Deputyship isn’t a quick process so won’t solve the immediate problems.

You need to apply for a Health and Welfare Deputyship and if you feel it is necessary a Financial Deputyship via The Court of Protection. If your DD lacks capacity to make decisions under The Mental Capacity Act .

if she is deemed to have capacity by the professionals - then even if you disagree with it she can make a risky or unwise decision.

unfortunately, the process is slow ( up to 18 months) and The Welfare Deputyship is more difficult to obtain.

It is a complex process and in my opinion you will need a solicitor, who specialises in this. Expect to pay £5 k plus for a solicitor.

you can try and talk to social services, but if your DD lacks capacity without a Deputyship for health and welfare in place they may have the final say.

@bugaboo218 I obtained welfare deputyship for my daughter about 3 years ago and it was much closer in total to £2,500 with the solicitor's fees.
