Background DS 17 years old is out of education, two tribunals but no one willing to take him all safety/ risk assessment including section 41. Still waiting for a suitable interim package, council given three months for a solution.
Technically he is no longer covered for prescription and at 18 will no longer be covered by dental trying to navigate this and the only option I can seem to find is applying for universal credit in his name. Has anyone done this or knows anything about the legalities. There doesn’t seem to be any option as a tick box for someone screwed over by the education dept.

Yes, DS, or his appointee, can apply for UC.

Or if you would receive more with DS remaining on your claim (some do) it is possible for child benefit, and thus UC, to be extended for 6 months and sometimes longer if DC can’t attend full time education for a good reason. See pg 9 here.

Have you considered EOTAS?

In the meantime the LA must still ensure anything detailed, specified and quantified in F is provided.

Thank you, we don’t qualify for UC or child benefit anymore, it’s mainly the dental fees I need to have something in place for as he needs multiple lengthy appointments. The lack of EOTAS or interim package is why the LA have been given a three month warning, but not holding my breath as already two months in.

Does your ds receive PIP, are you his appointee? If yes, you can apply for UC for him yourself online. You’ll be guided through the process and what’s expected of you. He will need fit notes from the GP to trigger a work capability assessment.

It’s actually very straightforward … I was so worried doing it for my dd but it really was very easy.
