Universal credit for 16yr old with severe learning disability

Hi

Can someone please help, can my son claim UC at 16 he’s got Autism, ADHD, severe learning disability and is non verbal. He’s still in school until he’s 19. I don’t claim benefits due to me and husband wages combine. Can my son claim it in his own right???

For a 16 year old who is still in full time education to be able to claim UC they need to be in receipt of DLA/PIP and have LCW/LWCRA established prior to them starting their course (or meet one of the other criteria which don’t apply here).

In order to establish LCW/LWCRA in advance of DS starting his next course you can make a credits only New Style ESA claim.

Thanks for you message DS is receiving DLA and we are applying for PIP. He’s at this school since he was about 5 years old, it is not a new course.

A new course isn’t the same thing as a new school. A young person can begin a new course whilst remaining at the same school.
