Post exam school attendance

DS1 is 16 and doing exams at the moment. He has ASD and an EHCP. He’s not academic and expected to get 1s or Us. For him school is more important in helping with his functional and social skills. He also compartmentalises quite extremely so he has never done school work at home (don’t ask about lockdown 😱) and will not revise / study at home.

School has just informed us that after the exam period, ie the end of next week, he will not be in school. This is a ‘reward’ for Y11s for all their hard work. We think DS would be better in school for the remainder of term. He does not have any friends and in the absence of school he has no purpose and will be climbing the walls.

I must have missed the bit on his EHCP where it says that school can opt out of educating him after exams. I am really angry. New SENCO at school at precisely the wrong time and have made no effort to discuss an alternative approach. Does anyone know if school can enforce this at all?

Is transition mentioned in the EHCP? Do any specified and quantified therapies/provision in F mention number of weeks per year? If the answer to either is yes, you would be able to enforce those via the LA (it is the LA who is ultimately responsible for ensuring provision is provided).

It is normal for Y11 to leave following exams. Legally DC cease to be CSA on the last Friday in June, so my initial thought (but I don’t know for certain) would be you could enforce attendance until that date but not after as then DC can be removed from the school’s roll unless they are returning there for Y12.

This is an interesting, if difficult one, it is something I am going to go away and research, if I find a definitive answer I will post back here for you.
