My daughter 15 has just being diagnosed a couple of months ago and somehow I think it is getting worse…common sense / executive skills / anxiety / independence / black white thinking

Will it get better?

This is crazy

She had 30% attendance in Y10
One day in Y11 at the mainstream
One day at special provision

I will read up the appealing process and do it by Friday
Also email the EHCN lead to discuss all the points above

You can’t yet. You need the right of appeal and you don’t have it yet. You need a finalised EHCP from within the last 2 months. But once you do unless the EHCP improves massively you need to.

Update -

So last night I emailed the head of service explaining DD's whole trajectory since joining secondary school and where she is at - unable to attend a reduced timetabled part time special provision outlining how much schooling she has been missing since Y10 and requested an alternative education – online schooling - provision under s.19 of the Education Act 1996. Got a reply this morning from the Director's executive assistant from the Assistant Director of Education telling me that my email has been sent to the service who will make contact with me.

I also sent an email to the EHC coordinator asking to discuss amendments on her EHCP and they already are taking steps with all people that need to be involved for a annual review even though it has not been a year yet - she also asked me what DD's option would be for post 16 and I asked for online schooling provision under s.19 too.

There are circumstances where annual reviews must happen before a year. In DD’s situation you should already have had one because she is a phase transfer year.

she also asked me what DD's option would be for post 16 and I asked for online schooling provision under s.19 too.

You can’t do this. That isn’t how it works. Provision/placements in EHCPs and the legislation governing them is completely separate to s.19 provision and the Education Act 1996. If you want online schooling in the EHCP you need EOTAS via the EHCP with section I blank and the provision included in F. Even if DD receives s.19 provision there still needs to either be a placement named in section I of the provision (as with s.19 provision pupils remain on the roll of the school even when unable to attend) or EOTAS with section I blank and the EOTAS provision in F.

That’s before you get to the point s.19 provision won’t apply to DD next year as it only applies to compulsory school aged pupils.

So during the review can I ask for EOTAS for over 16 - and perhaps keep things as it is with the special provision since they are coming up with many ideas for interventions to hime tutoring to 1:1 at the location.

EOTAS can be pre or post 16. If you want online schooling in the EHCP then yes you need to request it at the AR.

and perhaps keep things as it is with the special provision since they are coming up with many ideas for interventions to hime tutoring to 1:1 at the location.

Sorry I don’t understand this part? If you mean and keep the school named then no not if you want EOTAS. If any part of the provision is to take place at a setting then it isn’t EOTAS the placement must be named in I.

Interventions, home tutoring and tutoring outside the home but not in a registered school can all be part of EOTAS, as can so much more.
