26 week deadline for final statement

Is that from the date we signed a form at the school saying we were requesting a statement or from the date that the SEN team actually received it?

BTW we received a letter dated the 23rd February to say the LEA were going to do a statutory assessment.

If you received a decision to assess on 23rd Feb, that is week 6. So Final Statement would be due on 13th July.

If you didn't do the application yourself, unless you did a Data Protection or Freedom of Information request, you won't know the date of the initial request or whether the LA complied with the timescale.

The clock ticks from the date the LA receive the request.

Give the LEA a few days and then contact them to see why its late, they may have a reason such as waiting for an amendment or a report.
If they don't have any good reason casually mention that you are considering a judicial review if you don't recieve it within the next 5 working days. That may speed things up, if not make it more formal by saying in a letter that your solicitor has suggested that you consider taking the LEA to a judicial review if you don't recieve a copy of the final statement in the next 5 working days. The LEAs have their own if you like "league tables" for having to issue statements on time and will not want to be late.

If you google it, it will explain it better than I can. But you won't need to go that far anyway the suggestion of it will get them moving.
