Tribunal in 2 weeks, LA want to hold an annual review of the statement next week!

Funny, that just happened to me. Well, tribunal is a month away and we had AR this week.

Our LA rep didn't even turn up.

Don't worry, it must be too late for any further evidence to go in.

StarOfValkyrie · 23/06/2010 11:52

Actually, it isn't so much that they want to hold one, more that they want me to sign something saying that I don't want one. LOL

I did say this was a joke didn't I?

I don't geddit though.

How did yours go though sugar? Did you all just stare blankly at each other and munch biscuits?

You should respond:

Yes, would love to review the statement. I propose it says "ABA programme with ABA tutors at school and home, funded by the LA"

silverfrog · 23/06/2010 14:56

reply saying oyu'd love to - sadly you are away next week, and busy the week after (!), but you would be happy to co-operate with any other dates they suggest.
just bat it back to them.

god know what they want - but you have play nicely, otherwise you can be sure that they manage to mention it at tribunal...

StarOfValkyrie · 23/06/2010 15:08

They wanna clarification of whether we will be meeting to discuss ds' educational needs, or whether it should be a review of the statement

I thought the two were the same thing?

OP posts:
Al1son · 23/06/2010 15:39

That's a clear admission that the statement won't be meeting his educational needs in my book!

sugarcandymountain · 23/06/2010 16:04

I don't understand how they can ask you to agree not to hold an AR. It has to be held within 12 months of the statement whether anyone wants it or not (although ours was only six months old so not due yet).

Our AR turned out to be just another school meeting - the SENCO didn't invite anyone else from outside the school and was rubbish in organising the paperwork, so it was just head, SENCO, me, mentor and LSA. No biscuits though

I made DS fill out an AR form and typed up my Parental Views of his progress - think the school felt I was being overly negative

If it is a proper AR, it is quite a useful opportunity to submit paperwork that you have control over, because that has to be included as appx to the statement. We also submitted a report from his LSA for the tribunal as it describes some of DS's behaviour.

StarOfValkyrie · 23/06/2010 17:31

I dunno either. I think coz it's so close to the tribunal date they want to use the tribunal as the AR perhaps? and want me cover their bottoms by making me sign that I agree to that so that I can't do them over for not fulfilling their statutory obligation or sommat. I dunno. Never have quite made out whether they are stupid or very very clever!

Do you think it's so they can make you do AR at same time next year? So they can withdraw any aba you win before DS goes to school?

StarOfValkyrie · 23/06/2010 18:33

Hmm, I was kinda assuming that the day that the new statement has to be issued as ordered by the tribunal will be the new key date. You might be right though although I SERIOUSLY doubt thier ability to work that one out.

It isn't something I'm concerned about, just trying to figure it out. It's very strange for sure.

What's your statement date, star? Reviews are 6 monthly for under 5's aren't they? So maybe they've just remembered that, realised you're off to tribunal and that it wouldn't look good if they hadn't reviewed in time (working on the basis your statement was due around the same time as ours, which was Dec)

SanctiMoanyArse · 23/06/2010 18:44

LMAO

CAn you see the look of surprise on my face? no? me neither. Wonder why.

lou031205 · 23/06/2010 18:54

I agree with Silverfrog. They have to review every 6 months if under 5. So given that you got yours in Jan, you need a review in July. They don't want you to be able to clobber them with that procedural error too!

StarOfValkyrie · 23/06/2010 19:37

ah silverfrog and lou I think you got it. The letter of request was just a formality to cover their bottoms and they actually meant nothing by it.

Get a shock when they see I've requested it go ahead then. Have no issues at all with them having to scrabble around for reports as well as doing the tribunal paperwork. Late evidence deadline approaching very fast.

(I know that looks odd, but the tribunal have so far done nothing the way they should and things have been posted all over the place on wrong dates etc. which is why we have such aa late late evidence date.

OP posts:
lou031205 · 23/06/2010 19:54

Don't forget that they can either:

-Keep the statement the same (so no change and no effect on your tribunal hearing)

-Cease to maintain the statement (They'd be crazy wouldn't they? )

-Ammend the statement (Would need to give you a proposed ammended statement and give you 15 days to make representations - so would go past tribunal date).

StarOfValkyrie · 23/06/2010 21:21

Thanks lou. I'd not paid too much attention to that so I guess, overall, the meeting would actually be a bit pointless!?

LOL at them trying to cease the statement.
