Hi...we have our annual review in 3 weeks and we are also going to tribunal of which the lea have our appeal papers. The lea will also be at the meeting aah! Now I know we are there to discuss the past year etc but what if he (LEA)brings up tribunal ? shall I say we are here only to discuss said point or not .has any one been in this situation ? what was the atmosphere like ? or shall I just go up and shake his hand and carry on as we always have in all the meetings.I`m a bit nervous I may say something and they will twist it at tribunal ( happened before ) The school is very much on our side

Don't pretend there isn't a tribunal. Say you feel that his needs have not been met over the past year, therefore there is a tribunal, and your input is reflected in the appeal document of which they have a copy.

Outside of that, you have no wish to give anything away, and you can tell them that too. It is a perfectly reasonable stance to take. I'll be in the same position shortly.

Good luck.

If the LEA change the statement does that make your current appeal nil avoid as not appealling the new statement iygwim....I would check with IPSEA maybe.

I know that it's possible to merge appeals, so that if an appeal is already pending but a statement is amended, there will be one hearing for both (which will usually be the date for the older statement).

His statement was changed 15th feb -we are in year 6 -and appealing 2,3,4...
angrywasp that makes perfect sense. I am so nervous ,(only because lea will be there )what will I be like day of hearing!!!They have only ever come to 1 meeting before and that was last year ,that one was his case worker but this one is the manager.

if case manager their maybe they might want to know what you want at tribunal and make an offer? as manager dont usually attend. What ever you do do NOT cancel tribunal if they say they will do x y z as you need to see it in that final statement first as they could promise and then throw it away once you cancel....you cant reapply if you cancel hold out for everything your dc needs and ensure it is in final statement...thats if that is their game. Good luck,,,I got annual review today and extremeley nervous.

Don't be nervous. Take someone with you and set some ground rules for yourself, such as:

  1. Even if an offer seems reasonable I will ask for it in writing to consider, rather than agree enthusiastically on the day.

  2. If I am asked a question, I will thank them for their interest and let them know my response when I have had a chance to think about it in a couple of days.

  3. If they ask me exactly what I want I will refer them to the appeal document. Same goes if they ask me why.

  4. I will not be defensive about anything. If I feel trapped I will take a 'no comment' stance (i.e. 'hmm, will need to think about that and get back to you')

etc etc.
