Hi,
I am just about to start my letter of requesting to the Sendist following our LEA refusing to assess my daughter for a statement.

Please can someone tell me-do I send off all the info and reports we have to them and just how detailed does my letter have to be-do I include the initial letter I sent to the LEA-this was 14 pages long with info on dd from birth till now and all family history.

Thanks so much
x

Yes, send as much information as you can. I'd recommend sending it Registered for extra peace of mind.

Have you filled out the appeal form from the SENDIST website? It is at the back of the pdf guide here. You don't need to write a separate letter to the tribunal, all the information can go in the form. There is a checklist which tells you all the documents that you must send - the LA's letter, your grounds for appeal and reports/documents.

You should also read IPSEA's Refusal to Assess Pack which will give you more advice on how to set out your grounds for appeal. I strongly suggest that you call IPSEA or SOS SEN for more detailed guidance on your case.

The space given in section 5 for giving your Reasons for Appeal is far too small and you will need to write it up separately, with care and reference to SEN COP and quotes from your supporting reports. You need to make sure it is comprehensive but also clear to read, focusing on the current situation rather than history.

yes ,agree with sugar ... our Reasons for appeal was in excess of 35 pages with quotes from private reports backing up your reasons. we have sent in all the evidence we have at moment and have been told we have till middle of june to get everything in. We still need to send in o/t report and we will also be having annual review very soon .Hope that helps . I admire you doing this on your own ,I will be glad when it is all over ...CANNOT sleep and it is on my mind ALL the time, work is a very welcome distraction!!

Hello sahs ...sorry back to school and night shift to deal with ... We put them under headings ,very similar to parental views if you like ,.eg introduction (appealing against parts 2,3 ,4 etc)summary, early years, school, our concerns (how it is affecting your child ,self esteem etc ),the issues ,our views on his recent statement, schools (current ,future)quotes from CoP,relevent info from independent therapists, etc .Yes it is long and very detailed, you have to make sure your grounds of appeal are valid, I assume they could say no at that point?.I have learnt SO much from here and as you may already know you feel completely alone and drowning. I panicked when this first started because I was scared that anything i did would jeopardise his decision at tribunal etc.(the LEA are very slippery )The school is completely on our side ..do you have that as a plus because that is a big plus x
