Blardy useless hospital trust!

My blardy useless NHS Trust has waiting lists for ASD assessments as long as its arm. I've been complaining about it and the lack of expertise in its CAMHS team for ages.

I got my MP involved.

Eventually got a rubbish letter back today sent to my MP but that's not what this post is about.

The stupid Trust only put the letter on its WEBSITE. So all the info about the complexity of DS's case and his wait for dx was uploaded for everyone to see. Really, how could this happen?

A journo spotted it apparently so the Trust had to come clean.

Think damages Debs for the distress and inconvenience in having to sort it out.

I certainly would.

I was thinking DPA breach but damages would be minimal wouldn't they?

pmsl that they do that to a lawyer!

cmeo (cry my eyes out) about the sheer level of audacity and incompetency that led to such an occurance.

You don't do it for damages Debs, you do it for an official record of incompetence that will form part of a tribunal bundle if and when you need it.

To add insult to injury, it had taken them weeks to get back to me and by the time they did, the CAMHS service had been officially transferred to another Mental Health Trust so they could shrug and say 'not up to us'!

I DPA breach wouldn't amount to any more than a slap on the wrist.

A formal complaint taken through all their levels of procedure could result in compensation (if only to avoid further publicity).

Look at it as a bit towards his Uni fund

OOoh, well Wet, interestingly there is a new set of Regs about breach of the DPA which came in on 6th April and which can result in big fines (granted not compo) for data controllers.

Wouldn't a formal complaint just end in an apology? They are writing to send that to me.

I think it has to be grounds for saying we no longer have any faith in this service

A formal complaint, pursued through allit's sucessive stages, will result in them writing to you asking what remedy you are seeking.

An apology and compensation for distress,etc is the norm and quite a reasonable remedy.

That's what the LGO awarded me.

TBH SENDIST wouldn't give a monkey's that they've screwed up.
