Private day nursery not doing IEP

DS attends private day nursery 3 days a week. He has an IEP for his verbal dyspraxia and is on School Action Plus as he has external intervention, i.e. from a S&LT. Nursery now say they are too busy to do exercises with him every session but can only find the time on a Monday. However this week they were too busy to do the exercises today. Does anyone know if they have to follow what is on the IEP or if because he is below statutory school age or it is private they can do what they blooming well like?

I don't think IEP's are enforceable without a statement anyway, it is more a tool and way of monitoring progress. Regular one to one time is quite a commitment for them and will take resources away from other children while they still have to maintain statutory ratios. Perhaps you need to consider if it is the right nursery for him unless they employ extra staff to carry out therapy or you could do the exercises at home?

Thanks LIZS, I do do the exercises at home but not on nursery days as after I've picked him up it's time for dinner, bath and bed, so it is helpful if nursery do them on those days. I have spoken to his S&LT today who is shocked that they have stopped doing them &, like me, doesn't understand why we had 2 professionals at the IEP meeting if they were not going to show a commitment to anything discussed. I fear this one will go on and on...
