It'll be interesting to see how they decide which dc are eligible for the £200, rather than £100...bet they'll use higher rate DLA (which my ds doesn't qualify for because he sleeps at night - although he is still very severely disabled when he's awake )

I heard that you can open CTF's for children that missed out on the £250 at birth. ie born before 2002. If you can then they should put the money in for older disabled kids.

I just won a tribunal on Tues (and am still celebrating!) in order to get higher rate Mobility for my ds who is 7 and has high functioning autism.

The panel actually looked visibly shocked at the decision making that goes on within the DLA offices.

In my son's case they took away the higher rate based on a doctors report which was by a doctor who had never met him.

RnB - same thing with me in December. The backpayment was lovely, but even better was the full apology I got from the DWP and the assurance that their decision makers will have to undergo training to make sure it doesn't happen to anyone else

The doctors that the DLA decision makers use are muppets. One report on J said that, "in the absence of a low IQ, there should be no problem with behaviour or need for extra supervision". This in the face of a child with a full time Statement and a billion reports recommending 1:1 / 2:1 support at all times for his own safety .

Yes am looking forward to the back payment - is 10 months since they took the benefit away so it is much anticipated.

You got an apology!? Wow, I hope they do the same to me. Do they have any idea just how stressful the whole ordeal is??

And don't forget to ask for a Special Payment - covers all the interest you accrued on credit cards cos of the loss of benefit, as well as postage, photocopying, phone calls etc. And cos the DWP guy admitted not following the law, they also paid me a few hundred quid for inconvenience etc. It was 18 months' worth of interest etc. so the total 'Special Payment' did add up a but.

Thanks, have just called them and asked for the special payment and compensation too. I feel like sending them an invoice for the MOT that cost me £500 on the damn car I had to buy.
