dd goes to an sn school. beed there since she was about 4(now 13)
over the years at various times we have claimed free school dinners, and had no problems.
Well I put in a claim in october.just got a letter saying no not entitled, saw the mistake(I sent in a tax credits thing and it had working tax credits on it) so rang to get it put right.
well it seems because dd goes to an independant school!! they don't pay for free school dinners.
obviously I have got the man jumping through hoops as I know we are entitled as dh is on jobseekers.
And Yes I used the D word.

Do you have to put in a claim to the local authority for her to have the free school meals? I had a free place at an independent school under the old assisted places scheme, and I think that I got free meals due to that, rather than from the local authority. Will ask my mum tonight what the arrangement was with my dinners.

i Think the council that the school in has to pay it, but they say no, my coucil have to pay, who say no the council the school in has to pay.......

having thought about, I see what you mean -as the reason she is indie school as it's the education that meets her needs due to SN, otherwise she would be in state school - so it's not really the same as being on an assisted place. so yep, a definite discrimination argument.

good news, i rang dd's school, they are dealing with it, and even have people in London looking into it. good thing is she is getting free dinners and I won't have to pay.

I'm glad someone's finally sorting it out for you. I agree that it would be discrimination if they'd insisted that she still wasn't entitled.
