My DD age 10, currently in year 5, has SEND needs, AuHDU, and working a year behind in subjects. Dos'nt have an an EHCP in place as the school are supporting her well at th moment. As she has a special chair in class, dose small group work, see the Family support worker, and emotional support lessons, currently

However we just went to view the local secondary schools open day, and they said it would be very useful if she had one.
She found the open day stressful due to the size and amount of people. Its a medium size school, 900 students.

How do I go about getting her an EHCP, and would she qualify.

You can request an EHCNA yourself. On their website, IPSEA has a model letter you can use.

The initial threshold is that for an EHCNA. It is a relatively low test - a) has or may have SEN, and b) may need special educational provision to be made via an EHCP.

The key part of that test is "may", it's an incredibly low bar to pass, the fact they are on the sen register at school is more than sufficient, but as the LA gets to make the decision they can ignore any evidence you supply. You can appeal this, and at my local council it's a common occurrence to get pushed back at the first hurdle.

You can ask your current school to apply for the EHCP or start it yourself.

An EHCP would demonstrate your child's needs, what provision is required, and what the outcome they get from that provision. The LA is then required to provide funding for the school to provide them the provision in the EHCP.

While the test for an EHCNA is relatively low, on its own, being on the SEN register is not more than sufficient to prove the legal test for an EHCNA. It is enough to demonstrate the first part of the test but, on its own, it isn’t enough to prove the second part, which is the harder part of the test to prove. For instance, it wouldn’t be enough to say to SENDIST my CYP is on the SEN register therefore meets the test.
