Hi all

Im sending my dd's dla appeal

On the original form I ticked that she can walk between 50 and 200m

I realise that was an error and that the answer is 0 - 50

My original answer was picked up by the assessor and was a factor in refusing hr mobility

If I note on the appeal that I'm changing my answer, will it go against me? Will the judge accept such a thing, has anyone tried it?

Unless you have strong evidence proving DD could only walk 0-50m at the time of the claim, I suspect it may raise questions. The panel may wonder why this wasn’t mentioned at the time of the initial claim, corrected after the application was submitted but before a decision, or mentioned as part of the MR.

My argument is that although she can physically walk, the smi means she's virtually unable to walk?

You are confusing two of the ways someone can qualify for HRM. SMI and VUW are different.

It would help you to look at the SMI and VUW criteria flowcharts in this document. Also look at Contact’s leaflet.

The mandatory reconsideration person said she doesn't qualify on both fronts so I've explained that due to her smi, she is virtually unable to walk

SMI and VUW are 2 different ways of qualifying for HRM. They have different criteria. The SMI route isn’t relevant to the VUW route, and vice versa. They are separate. SMI does not automatically equal VUW. I urge you to read Contact’s leaflet and the flowcharts to understand this more.

I've removed my bit about the distance because even though i did tick the wrong box, agree, it just seems like I've changed my mind but I've highlighted the trouble she has with walking less than 100m

mumofoneAlonebutokay I've had to rush my forms as I have so much going on with my sons health also looking after my mum too so I've not had time to seek professional help my MR i only got 2 weeks as the form was 2 weeks late so left me with 2 weeks to fill it out i feel exhausted by it all my ds EP has done a new report for him stating he finds it hard to regulate himself after a meltdown throws tables and chairs broke his hand in school punching a wall he has scored very low in all subtests less than the 1st percentile in all tests I've done all I can its just a waiting game now hopefully mumofoneAlonebutokay youare successful with your appeal fingers crossed for you x

Omg @Kittenheaven23 same, i recieved it a week after the appeal date and then had to borrow a laptop from the library as I don't have one 🙃 so had days to do it

So rushed 🥺

The new evidence will definitely strengthen your case! I haven't submitted anything new so super super worried but cest la vie, just have to hope and pray

We really need the extra support, especially as dd is getting bigger and stronger now

Fingers crossed for success for both of us 🥰

That's how I feel I've done what i can what will be will be I'm on MRC LRM but feel as though he should be on HRC at least also hopefully HRM aswell through his violent outbursts disruptive behaviors which the teachers and EP has also backet it up on there reports hes 14 and he's working at the equivalent age of 5-7 yrs old has your dd been diagnosed my ds is waiting on a diagnosis been waiting well over a year for appointment can't see him getting one anytime soon

Yeah she has her diagnosis, she got it early thankfully

For us, shes so gentle but still has severe needs. Really hope your appeal goes well - i think the average wait time is 6 months! x
