I have been told that you can send in late evidence if a dla application is declined for it to go to the same decision maker for the decision to possibly change. This would be before starting a mandatory reconsideration. Is this correct as I cannot find any information online regarding this.

It can sometimes happen but it doesn’t always and there isn’t a right for it to happen and don’t miss the MR deadline.

I think it depends on whose desk it lands on and who the DM was.

I mean I think it is the luck of the draw in relation to what employee looks at the new evidence and what decision maker looked at the claim rather than any hard and fast rules.

I see, well the person I spoke to on the phone said that it should go back to the same decision maker if I sent in late evidence?
