Who is our LEA for SEN child over two counties?

Our GP is registered in one county.
We pay our council tax to a different county/vote for a different area.
Our postcode is the same as our GP, our postal address works for either county as it is right on the border.

DS was at school in our home county but is now moving to a private school in the same county as our GP.

Which local authority would we apply for an ECHP to?
-Same county as GP?
-Same county as new school?
-Same county that we pay council tax to?

You make the request for an EHCNA to the local authority you live in. If you don’t know who that is, you can find it here by putting the postcode of your home in. It doesn’t matter if this is different to the LA the GP &/or school is in. Because of how district and county councils work, it isn’t always the same as the council you pay council tax to.

I agree it is the LA where you live and the EHCP is paid at the band and rate they set.

We have children from different LA's and the funding varies. They all have different procedures. Some funding like holiday provision is for own LA children only and other children can attend at their own cost.

LAs are ultimately responsible for providing the provision detailed, specified and quantified in F. That includes providing sufficient funding. This applies whatever bands or rates they set.
