How much supervision is required for dla?

The rate the child gets depends on the level of looking after they need, for example:

  1. lowest rate - help for some of the day
  2. middle rate - frequent help or constant supervision during the day, supervision at night or someone to help while they’re on dialysis
  3. highest rate - help or supervision throughout both day and night, or a medical professional has said they might have 12 months or less to live

So, i assume that for highest rate, the supervision needs to be ‘constant’ day and night?

From my understanding yes,

for example, my son sometimes needs supervision in the night but not constant or every night so he got middle care - but I could be wrong!

As well as the care component, for DC 5+, low rate mobility is for help or supervision outdoors. High rate care doesn’t require ‘constant’ supervision day and night, rather help or supervision ‘throughout’ the day and night. All are looked at through the lens of comparing to a typical child of the same age, and are about the majority of the time.

Not sure which part you mean but:
What the different rates are for is explained here. As is the fact children can’t receive low rate mobility before the age of 5. Also in Social Security Contributions and Benefits Act 1992.
61521 here states “they require
2.1 substantially more care from another person than children of their age would normally require or
2.2 care that children younger than them in normal physical and mental health may need but a child their age in normal physical and mental health would not require”
Which essentially means a child’s need for care and supervision is looked at compared to typical DC their age.
DMs will look at the child needs most of the time. Although this doesn’t e.g. mean someone who, as well as daytime care, only needs significant support 3 night a week can’t receive high rate care e.g. if the care they do need is lots of hours during those 3 nights.
