Is there a long wait for a Sen primary school in croydon if child already has EHCP

With an EHCP admissions don’t have waiting lists in the same sense ordinary admissions do.

With an EHCP, unless the school is wholly independent, the LA must name your preferred school unless the LA can prove:
-The setting is unsuitable for the age, ability, aptitude or special educational needs (“SEN”) of the child or young person; or
-The attendance of the child or young person would be incompatible with the provision of efficient education for others; or
-The attendance of the child or young person would be incompatible with the efficient use of resources.

However, many parents have to appeal. If you currently have the right of appeal and the LA has not named your preferred school you should appeal. If you don’t currently have the right of appeal you should request an early review.

Ok I'm still a bit confused. His EHCP says preferred school is mainstream as it was done before he started reception. Now in year one the EP has visited and said she recommends specialist setting

So is he likely to be in one for September? Or longer

There’s too many variables to say if DS will have a special school placement by September.

In what context has the EP said DS needs a specialist school and has she put it in writing?

Is it following an annual review? In which case, the LA has 4 weeks from the annual review meeting to inform you if they are going to amend or not. If they aren’t going to amend, you will get the right of appeal. If they are going to amend, they must issue an amendment notice when they inform you they are going to amend. At that point you will be able to name your preferred school. Then the LA must finalise within a further 8 weeks. Once finalised, you will get the right of appeal if the LA doesn’t name your preferred placement.

Is it part of a reassessment of needs? If so, following the reassessment of needs, the LA will decide if they are going to amend or not and finalise within 14 weeks. Following this, you will get the right of appeal if the LA doesn’t amend to name your preferred placement.

If the EP has said it in another context, you should request an early review. Unfortunately, there’s no guarantee the LA will agree to an early review. If they refuse, you will need to wait for the annual review or request a reassessment of needs.

If you have to appeal, you won’t have a place for September. If you don’t have to appeal, then there’s time.

The EP came in to review the provision for year 1 so that's how it has come about. I don't know did she do a report on all the kids with Sen or just Mine but yea it's in writing in a report she did and how EHCP review is in May

At the annual review you can make it known you want a specialist school. Then my 3rd paragraph above applies. Following the AR, if the LA does not name your preferred school you should appeal.

I've already fired of an email and told the senco this but obv won't hear back as Easter holidays

You need to raise it as part of the review process too because it will be the LA who decide whether to amend or not.
