Independent school and EBSA

My 11 year old is refusing school due to anxiety which has built up over years at her school. She has few friends and we have struggled to get them to put the right support in place. She has talked about suicide and depression and we have kept her off school whilst we find a psychologist to assess her.

My question is this - what are independent schools required to do by law when there is a private ASD diagnosis and they have fundamentally failed to put things in place to make sure she is able to learn based on the report that was provided by an Ed psych. They refused to help us with the things we have asked and the situation has become dire.

There is only a little time before she leaves this school anyway but currently I cannot see a way back. Can anyone help with advice?

The school must make reasonable adjustments. Unfortunately the best endeavours duty placed on other schools doesn’t apply to independent schools.

Sadly many independent mainstream schools aren’t supportive of SEN and when they are often charge extra.

If DD can’t attend school due to her MH or SEN the LA must provide alternative arrangements to ensure DD receives a suitable, full time education. This should begin once it becomes clear 15 days will be missed.
