DLA tribunal hearing - what to expect

So I have a date and am nervous. Not because I doubt my DS claim but because I don't know what to expect?

I have significant evidence of what is in place for my son, and have also moved him schools where his needs are being supported and they are working with the various agencies involved with him. There was only one piece of evidence against my son's claim and that came from his old school claiming he was OK. I will never understand her comments as I was able to prove what was on place and the referalls they had made etc but here I am.

So I know what I'm fighting against and it worries me. Her dishonesty has meant I am having to fund his aids and supports privately which is crippling me.

Has anyone been to tribunal and can let me know what to expect/how it went? I'm not just looking for positive experiences, but both. I have this idea that they are going to be really tough on me

So for us the Judge told me to wait until the following week for the decision but the appeal call I had didn't last long and it felt like their mind was made up before the call even started. So maybe that's why mine was available so quickly as it had already been decided.

I also got the decision notice through the post the following Monday (Thursday hearing, Monday post arrived). The DLA then took nearly 3 weeks to contact me to set up the backpayment and they said this was due to the volume of tribunal hearings they have

Hi so i called dla today and as i thought the tribunal has sent them info
My daughter was awarded MRC and LRM from may 2023. Dose anyone know how long it takes for payment and as its MRC will there be any changes to my UC thanks so much for responding yesterday

Congratulations.

So for me it took around 4 weeks to get the backpay and longer from tax credits. They said it was because it was a high value payment. It was backdated for 18 months.

I've seen some get it alot soon.

I updated TC the day I found out and because it spanned over 3 tax years it had to got to a specialist team. I would update UC with the rate your child has been awarded and the from date and ask for any disability and caring elements to be added

Only from May 2023?

You will be eligible for the disabled child (£456.89) and carer (£185.86) elements on UC. You will need the date, so wait for the letter.

Yeah thats when first applied i was shocked to receive the tribunal letter a few weeks ago as ive herd some people are waiting absolute months for a date

I thought the disabled child element would be lower one as shes getting MRC not HRC

That’s why I checked as in some areas it could quite easily be May 2022. Ah, yes you are right. The disabled child element would be the lower amount. I forgot you said MRC. It will be £146.31. Sorry.

Hi everyone, could anyone let me know how long it took to get your appeal date please? Currently put my appeal through around 2 weeks ago and just wondered on timing. Thank you in advance

From start of appeal to hearing it was approx 10.5months but from start to finish total was 19 months from first claim

Hi all , I have just received a date for my sons DLA tribunal….it has taken just over 11 months …although I am glad to see the end is in sight I am feeling a little apprehensive….can I just ask will the panel already be aware of my sons medical condition prior to the hearing or will I have to explain it from scratch?
CAB helped me fill in the form will I need to have one of them with me for the hearing? Mine is a video hearing what are your experiences on this please? Any help would be appreciated x

The panel will have all the evidence prior to when the hearing starts. Mine was over in minutes being told the evidence was basically overwhelming. I barely had to explain anything. Try not to worry. I found the tribunal experience absolutely fine.

@Shellbod81 you don’t need CAB to attend, but they can sometimes represent you if you want. The panel with have the bundle beforehand. They may still cover the different areas covered by the form though, ask questions etc.

Thank you both for your replies , be greatful when it’s over it’s been a very long battle but o am very interested in what the panel will have to say as the amount of evidence I have sent in is overwhelming (over 200 pages)

I’ve been refused HRM for my little girl MR,because her asd report said she’s been active from an early age and she likes to run and jump,also because school have said she’s behind with her reading but does enjoy reading and school said she’s uses now next and then visuals
i need to know is it worth going further

@Doddy76 with autism, there are two ways of qualifying for HRM - SMI and VUW. You can see the SMI and VUW criteria flowcharts in this document. To be eligible you need to prove every part of test. Also look at Contact’s leaflet.
